1. Shipping Terms and Conditions

1. This Agreement is between you, the person placing an order for goods using the website www.awasunglasses.com ("You") and AWA Sunglasses (hereinafter the Website) owned by AWA Sunglasses, SLU

1.1 In these terms:

“Goods” means the products made available by AWA Sunglasses that you wish to purchase, as indicated in your order.

"Order" means orders placed in accordance with the provisions of Section 3.1. "Site" means the website owned and operated by AWA Sunglasses, SLU with http://www.awasunglasses.com as its URL.

2. Customer Obligations

2.1 By submitting your order you warrant, represent and undertake that:

2.1.1 You are over 18 years of age and are not ordering on behalf of another person

2.1.2 Provide any details reasonably requested by AWA Sunglasses to confirm that you are eligible to purchase the Goods

2.1.3 That you are acting in your capacity as an individual and the consumer goods or any part of the products will not be used for resale or for anything other than your own personal use.

2.1.4 That you are the authorized holder of any credit/debit card that may be used on the site.

2.1.5. In order to purchase the goods offered through the Website, the User must register using the registration form available on the Website. The User shall be responsible for maintaining the confidentiality of the data and information provided and for restricting access to their computer and passwords to prevent unauthorized use.

If the User has reason to believe that their data has been disclosed to a third party, or if it has been used in an unauthorized manner, or is likely to be, they must immediately notify AWA Sunglasses of this situation.

The User must verify that their information is correct and complete and inform AWA Sunglasses of any changes or modifications to the information provided during the purchasing process.

3. Orders for goods

3.1 Orders must be placed:

3.1.1 The services and products offered through the AWA Sunglasses Website are intended for the purchase by Users of AWA Sunglasses brand sunglasses.

To place an order for AWA Sunglasses, the User must be over 18 years of age.

From the website www.awasunglasses.com, AWA SUNGLASSES, SLU will ship orders to any part of the world.

To place orders through the Website, the User must provide a series of details prior to placing an order, using the purchase form. This information will be necessary to process your order.

4. Limitations of the Offer

4.1 AWA Sunglasses will use reasonable efforts to meet the requirements you specify in your order(s); however, we cannot guarantee the availability of the goods. If the goods you have purchased cannot be supplied, AWA Sunglasses will contact you to give you the option of receiving a replacement or a refund. If AWA Sunglasses does not respond from you, AWA Sunglasses may, at its sole discretion, substitute goods of equivalent quality and/or specification or cancel the order and provide a refund.

4.2 The information included on the Website in each product and service description, in its photographs, graphic or iconographic representations, or videos, as well as trade names, trademarks, or distinctive signs of any kind, is for informational purposes only. Therefore, AWA Sunglasses declines any liability for errors in such information, although it undertakes to take all measures within its power to correct any errors or omissions as quickly as possible after being informed of them.

5. Prices and Payment

5.1. Once the form has been completed, the User must proceed to pay for the order using the payment methods specified on the Website. After payment is made, the User will receive an order confirmation email, which will include a summary of the items purchased, the requested shipping method, and the destination address.

If an incident occurs at the time of payment that prevents the payment from being made, the User will receive an automatic payment error message and their order will not be processed until the payment process is successfully completed.

Service prices are expressed in Euros (€), including taxes, handling, and shipping costs, the amounts of which will be indicated upon final confirmation of each order.

All prices shown are final prices, expressly including Value Added Tax (VAT). Users will always be provided with detailed information on the product price. In the case of the Canary Islands, VAT will be excluded when making the payment for the order.

5.2 The prices applicable to each Product will be those published on the Website on the date the User places the Order. Although AWA Sunglasses attempts to ensure that all prices listed on the Website are accurate, errors may occur. In the event of an error in the price of any of the Products ordered by a User, AWA Sunglasses will inform the User as soon as possible and give the User the option to reconfirm the Order at the correct price or cancel it. If AWA Sunglasses is unable to contact the User, the Order will be deemed canceled, and the User will be fully refunded for any amounts paid.

a) Payment method

The User may pay by credit or debit card or through PayPal. To minimize the risk of unauthorized access, the User's credit card information will be encrypted. Whether payment is made by credit or debit card or through PayPal, the charge will be made when AWA Sunglasses sends the Order Confirmation to the User.

b) Delivery of the Products

Once the Shipping Confirmation has been sent, the Products will be delivered to the address indicated by the User when placing the Order within approximately one to five (1-5) business days according to the official calendar of the Community of Castilla y León (Spain), excluding Saturdays and holidays, counting from the day of purchase.

For express shipping, when available, delivery will be within 24/48 business hours according to the official calendar of the Community of Castile and León (Spain), excluding Saturdays and holidays, starting from the day of purchase.

AWA Sunglasses assumes no liability when delivery of the Product is not made as a result of the data provided by the User being false, inaccurate, or incomplete, or when delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the User or the retention of the Product in Customs.

c) Shipping costs

Shipping costs include transportation, insurance, and customs clearance at origin.

For deliveries to countries outside the European Union, customs duties and other taxes (tariffs) are not included; the recipient must pay these in cash to receive the goods.

The recipient will be responsible for all import fees and taxes incurred at the destination customs office, whether or not the goods are delivered to the recipient.

We will endeavor to ship your order as quickly as possible, but the recipient must take into account the import regulations of the destination country for the items ordered, as AWA Sunglasses is not responsible for these regulations. AWA Sunglasses will also not be held responsible for any effects caused by strikes, force majeure, or other circumstances beyond its control. AWA Sunglasses will not be liable for delays in customs clearance or if local authorities decide to confiscate any items contained in a shipment.

6. Returns and exchanges of products

a) Right of withdrawal

In accordance with applicable regulations, if the User is contracting as a consumer, he/she may withdraw from the contract (except in the cases established by law) and freely return or exchange the Products delivered at any time within a period of fourteen (14) calendar days from the date of delivery (the “Withdrawal Period”).

The User must bear the direct cost of returning the product to AWA Sunglasses, whether they return the entire order or decide to return only some of the products in the order.

To formalize the return, you must contact AWA Sunglasses at the following email address: info@awasunglasses.com. Upon receipt of this communication, AWA Sunglasses will inform you how to ship the order to its offices or warehouses. After the Withdrawal Period, Product exchanges or returns will not be accepted. Exchanges will only be accepted for Products that may have been found to be defective in accordance with the provisions of section b) below.

b) Return or replacement of defective Products

If the User believes that the Product does not meet the specifications established for said Product, they must immediately contact AWA Sunglasses by sending an email to the contact address info@awasunglasses.com, providing the Product details, as well as informing them of the defect and whether they prefer a return or replacement with an identical Product.

Once the relevant inspection of the returned Product has been completed, AWA Sunglasses will send, within a reasonable period of time, an email to the User informing them whether the Product is eligible for a return or replacement (the “Return or Replacement Decision”). In such case, the return or replacement of the Product will be made as soon as possible and, in any case, within fourteen (14) calendar days following the date of sending the Return or Replacement Decision. In the event that the return is eligible, AWA Sunglasses will not reimburse the shipping costs.

If the User only wishes to return one or some of the products included in the order, AWA Sunglasses cannot refund the shipping costs the User paid for the entire order. If the User opts for a replacement, AWA Sunglasses will cover all shipping costs.

In the case of glasses with manufacturing defects, AWA Sunglasses undertakes to replace them with new ones. AWA Sunglasses will cover the collection and delivery costs in this case.

To proceed with the product replacement, the user must contact AWA Sunglasses by email at info@awasunglasses.com, providing the product details, as well as informing them of the defect and their web order number.

The product must be unused and include all tags, packaging, and—if applicable—original documentation and accessories that came with it. If the User fails to do so, or if the product has been damaged in any way, the User accepts that the product may be depreciated or that AWA Sunglasses may refuse the return.

This manufacturer's warranty does not cover:

– Scratched lenses. Improper use or poor maintenance is not covered.

c) Common provisions for returns

The User must meet the following requirements to exercise the right of withdrawal, as well as to be able to return and replace Products:

(i) To arrange the return of the Product, the User must first contact AWA Sunglasses by sending an email to the contact address info@awasunglasses.com;

(ii) The User may prove the exercise of the right of withdrawal in any manner permitted by law, and in all cases it shall be considered validly exercised by returning the Product;

(iii) The Product must be returned in the same condition as it was received.

AWA Sunglasses will not refund any amount if the Product has suffered any damage,

Therefore, the User must be careful with the Product while it is in his possession;

(iv) AWA Sunglasses will not be responsible for any package sent by the user in the exchange, return, or repair process. Therefore, we strongly recommend that all shipments by the user be made traceable with a tracking number or similar; and

(v) The refund will be made using the same payment method that the User used to pay for the Product.

7. Product Exchange Policy

AWA Sunglasses does not support the exchange of a product purchased by the User for another product offered on the Website.

If the User wishes to exchange a product, they must exercise their right of withdrawal as established in clause a) and subsequently purchase the new product they desire.
